Terms of service

These terms ("Consulting Terms") govern your engagement with Funnel Vision – ABN 17 559 377 143 – for digital consulting services including, but not limited to, SEO, conversion rate optimisation (CRO), digital strategy, and website development ("Services").

By purchasing or engaging in any consulting service through this website, you agree to these Consulting Terms, which operate in conjunction with our [Terms of Service] and [Privacy Policy].

1. Scope of Services

Services offered may include SEO audits, strategy development, website migrations, CRO enhancements, or other digital marketing support. Specific deliverables, timelines, and outcomes will be confirmed via written communication (e.g. email, proposal, or scope document).

Funnel Vision provides recommendations based on experience and industry best practices. You acknowledge that outcomes such as increased traffic, rankings or sales cannot be guaranteed.

2. Payment & Fees

All service fees must be paid in advance or as otherwise agreed in writing. Payment terms (such as deposits or instalments) will be confirmed prior to commencement.

Unless otherwise stated, all amounts are in AUD and exclusive of GST.

Late payments may result in project delays or suspension of services. Where an invoice remains unpaid for more than 30 days, Funnel Vision reserves the right to refer the outstanding balance to a debt collection agency. All associated fees and charges for recovery will be payable by you.

Additional work requested outside the agreed scope (including urgent turnarounds or expanded deliverables) may incur additional charges. Work performed outside standard business hours (Monday to Friday, 9am–5pm AEST) may also attract an after-hours surcharge, which will be discussed and agreed upon in advance.

3. Intellectual Property & Licensing

All materials, strategies, and deliverables shared during the project remain the intellectual property of Funnel Vision unless expressly stated otherwise.

You are granted a limited, non-transferable licence to use the provided deliverables internally within your business. You may not reproduce, resell, or distribute materials without prior written approval.

4. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information exchanged during the engagement. This includes but is not limited to login credentials, performance data, strategy documents, and business plans.

5. Limitation of Liability

To the maximum extent permitted by law, Funnel Vision’s liability arising from the Services shall be limited to the total fees paid by you for the relevant Services. We will not be liable for indirect or consequential losses, including loss of profit, business interruption, or data.

You acknowledge that digital results are affected by external factors beyond our control, such as search engine algorithm changes, third-party platform updates, technical hosting issues, or delays in receiving access or approvals from your team.

6. Force Majeure

Funnel Vision will not be liable for any failure or delay in performing its obligations under these terms due to circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, power outages, cyberattacks, civil unrest, strikes, internet outages, pandemics, or government restrictions.

7. Client Responsibilities

You agree to provide all necessary access, information, and timely communication to allow the Services to be delivered effectively.

Delays in providing this access or feedback may impact delivery timeframes and are not the responsibility of Funnel Vision.

8. Termination & Refunds

You may cancel services at any time in writing; however, no refunds will be issued for work already commenced or completed.

Funnel Vision may also terminate services with notice if these terms are breached or if you become unresponsive for a sustained period. You will be billed for any work delivered up to the date of termination.

9. Support Personnel

Funnel Vision may work with contracted consultants, support staff, or other specialists to deliver the Services. All work remains under our oversight to ensure consistent quality.

10. Time Limit on Claims

Any claims or disputes relating to the Services must be raised in writing within three (3) months of project completion. Claims submitted outside this window will not be accepted.

11. Dispute Resolution & Governing Law

These Consulting Terms are governed by the laws of New South Wales, Australia. Any disputes shall be handled in the appropriate courts within NSW.

If a dispute arises, both parties agree to attempt resolution via good-faith discussion prior to initiating legal action.

12. Acceptance

By purchasing or confirming any consulting service from Funnel Vision, you agree to be bound by these Consulting Terms. If you do not agree, please do not proceed with the engagement.
